Terms of Service
Effective August 3, 2026
These Terms of Service ("Terms") govern your access to and use of the Cruz Culinary website. Cruz Culinary is a culinary consulting business based in Long Beach, California. In these Terms, "Cruz Culinary," "we," "us," and "our" refer to Cruz Culinary and "you" refers to a website visitor or user.
By accessing or using this website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.
1. Website Purpose
This website provides general information about Cruz Culinary, hands-on kitchen training, IDDSI implementation support, educational content, and ways to contact us. The website also provides links to Cruz Culinary's cookbook, videos, and social media pages.
The website does not process payment for consulting services, schedule training, or form a consulting engagement.
2. Inquiries and Consulting Relationships
Submitting an inquiry, sending an email, or calling Cruz Culinary does not create a consultant-client relationship and does not obligate either party to enter into an engagement. An inquiry is only a request for Cruz Culinary to contact you about potential services.
Any scope of work, pricing, schedule, deliverables, responsibilities, cancellation terms, or other service terms will be discussed and established separately between Cruz Culinary and the prospective client. If a separate proposal, statement of work, or agreement conflicts with these Terms regarding paid consulting services, that separate agreement will control those services.
Cruz Culinary may accept or decline an inquiry in its discretion and does not guarantee a particular response time, availability, result, or outcome.
3. Educational Information; No Medical Advice
Website text, videos, recipes, demonstrations, downloads, and other content are provided for general informational and educational purposes. They are not patient-specific medical, clinical, nutritional, dietary, legal, regulatory, or other professional advice and should not be treated as a substitute for advice from qualified professionals who understand a facility, its patients or residents, and the applicable requirements.
Healthcare facilities and their qualified clinical, dietary, and operational professionals remain responsible for patient-care decisions, assessments, prescriptions, menu approval, food-safety practices, staff competency, regulatory compliance, and implementation of any IDDSI-related processes. Always use the current official standards and applicable laws, regulations, policies, and professional guidance.
Cruz Culinary does not guarantee that use of website information will achieve a particular clinical, safety, compliance, accreditation, financial, or business result.
4. Do Not Submit Patient Information
The website and inquiry form are not designed to receive patient records, protected health information, medical histories, or other sensitive patient information. Do not submit patient names, medical records, diagnoses, treatment information, or other information that identifies a patient. You are responsible for ensuring that information you submit may lawfully be disclosed.
5. Acceptable Use
You agree not to:
- Use the website for any unlawful, fraudulent, or harmful purpose;
- Attempt to gain unauthorized access to the administrator area, accounts, databases, systems, or networks;
- Interfere with the website's operation, security, or availability;
- Introduce malicious code, conduct vulnerability testing without written permission, or attempt to bypass access controls;
- Impersonate another person or misrepresent your identity, authority, or affiliation;
- Use automated tools to scrape, copy, or extract website content in a manner that burdens the website or violates applicable law; or
- Infringe intellectual-property, privacy, confidentiality, or other rights.
6. Information You Submit
You represent that information you submit through the website is accurate to the best of your knowledge and that you have authority to provide it. We will handle personal information as described in our Privacy Policy.
Do not submit confidential trade secrets, patient information, or other sensitive information through the general inquiry form. An inquiry does not create a medical, clinical, fiduciary, attorney-client, or other legally privileged relationship.
7. Intellectual Property
Unless otherwise stated, the website and its original text, graphics, branding, photographs, layout, and other content are owned by or licensed to Cruz Culinary and are protected by applicable intellectual-property laws. Third-party trademarks, videos, fonts, and other materials remain the property of their respective owners.
Cruz Culinary grants you a limited, revocable, nonexclusive, nontransferable right to access and use the website for lawful, personal, or internal business informational purposes. You may not reproduce, republish, sell, license, distribute, modify, create derivative works from, or commercially exploit website content without prior written permission, except as allowed by law.
8. Third-Party Content and Services
The website includes embedded YouTube videos and links to Amazon, YouTube, Instagram, TikTok, Facebook, and other third-party services. These services are controlled by third parties and are governed by their own terms and privacy practices. A link or embed does not mean Cruz Culinary controls or guarantees the third-party service.
Cookbook purchases take place on Amazon, not on this website. Amazon controls checkout, payment processing, order fulfillment, shipping, returns, availability, and other marketplace terms. Questions about an Amazon transaction should be directed to Amazon under its applicable policies.
9. Website Availability and Changes
We may change, suspend, restrict, or discontinue any portion of the website at any time. We may also correct errors or update content without notice. We do not guarantee that the website will always be available, uninterrupted, secure, current, complete, or error-free.
10. Disclaimer of Warranties
To the fullest extent permitted by law, the website and all website content are provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. Cruz Culinary disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement, to the extent those warranties may lawfully be disclaimed.
Nothing in these Terms excludes a warranty or right that cannot be excluded under applicable law.
11. Limitation of Liability
To the fullest extent permitted by law, Cruz Culinary and its owners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, goodwill, or business opportunities; or damages arising from reliance on website content, inability to use the website, third-party services, or unauthorized access to or use of information.
These limitations apply regardless of the theory of liability and even if the possibility of damages was known. They do not limit liability that cannot lawfully be limited or excluded. Any liability concerning separately contracted consulting services is governed by the applicable service agreement and law, not solely by these website Terms.
12. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any dispute arising solely from the website or these Terms will be brought in a state or federal court with jurisdiction in Los Angeles County, California, and each party consents to that court's jurisdiction and venue.
13. General Provisions
If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. These Terms and the Privacy Policy constitute the agreement concerning use of this website, but they do not replace a separate written agreement for consulting services.
14. Changes to These Terms
We may update these Terms to reflect changes to the website, business practices, or law. Revised Terms will be posted on this page with a new effective date. Your continued use of the website after revised Terms take effect means you accept the revised Terms.
